We provide WhatsApp Cloud API-based solutions including but not limited to:

Bulk messaging and broadcasting
Chatbot and automation setup
Message template creation and management
Analytics and reporting
Technical support and consultation
Our services are available to businesses across all industries — retail, education, healthcare, real estate, e-commerce, local services, and more.
3. ELIGIBILITY
By using our services, you represent and confirm that:
✅ You are at least 18 years of age
✅ You have the legal authority to bind your business/organization
✅ You are not located in a country subject to trade sanctions
✅ You will comply with all applicable laws and regulations
4. ACCOUNT REGISTRATION
To use our services, you must register for an account. You agree to:
Provide accurate, current, and complete information
Maintain and update your information as needed
Keep your login credentials confidential
Notify us immediately of any unauthorized access
Be responsible for all activities under your account
We reserve the right to suspend or terminate accounts with false or misleading information.
5. WHATSAPP CLOUD API COMPLIANCE
Since our services are built on WhatsApp Cloud API by Meta, you must comply with:

B. Key Requirements:
✅ You must obtain explicit opt-in consent from customers before messaging them
✅ You must provide clear opt-out instructions in every message

✅ You must not send spam, abusive, or misleading content
✅ You must comply with the 24-hour customer service window rules
Violation of WhatsApp policies may result in suspension or permanent ban of your WhatsApp Business account. We are not liable for such actions.
6. PROHIBITED CONTENT & ACTIVITIES
You agree NOT to use our services for:
❌ Illegal activities or promoting illegal products
❌ Hate speech, harassment, or discrimination
❌ Sexually explicit or obscene content
❌ Violence or threats
❌ Misinformation or deceptive practices
❌ Malware, phishing, or fraudulent schemes
❌ Unsolicited bulk messaging (spam)
❌ Violating any third-party rights (intellectual property, privacy, etc.)
We reserve the right to suspend or terminate services for violations without prior notice.
7. PAYMENT & REFUNDS
A. Fees:
Our service fees are clearly displayed on our website or in your agreement.
Fees may be one-time setup, monthly subscription, or usage-based (per message/conversation).
All fees are exclusive of applicable taxes.
B. Payment Terms:
Payments are due as per the selected plan.
We use third-party payment processors. We do not store your payment details.
C. Refund Policy:
Refunds are governed by our Refund and Cancellation Policy (see separate page).
Generally, setup fees are non-refundable once work has begun.
Subscription fees may be refunded on a pro-rated basis in certain cases.
Disputes must be raised within 7 days of payment.
8. INTELLECTUAL PROPERTY
A. Our IP:
All content on our website, including text, graphics, logos, software, and APIs, is the property of Easten Mediatech or its licensors and is protected by intellectual property laws.
B. Your IP:
You retain ownership of your content (messages, templates, business data). By using our services, you grant us a limited license to process, store, and transmit your content solely to provide the services.
C. Feedback:
If you provide suggestions or feedback, we may use them without compensation or obligation to you.
9. THIRD-PARTY SERVICES
Our platform integrates with:
Meta (WhatsApp Cloud API)
Payment gateways
Analytics tools
Cloud hosting providers
We are not responsible for the actions, content, or policies of third-party services. Your use of third-party services is at your own risk.
10. LIMITATION OF LIABILITY
To the maximum extent permitted by law:
⚠️ We provide our services "AS IS" and "AS AVAILABLE" without warranties of any kind.
⚠️ We do not guarantee that our services will be uninterrupted, error-free, or secure.
⚠️ We are not liable for any indirect, incidental, special, or consequential damages.
⚠️ Our total liability to you shall not exceed the amount you paid us in the last 3 months.
11. INDEMNIFICATION
You agree to indemnify and hold harmless Easten Mediatech, its employees, and affiliates from any claims, damages, or expenses arising from:
Your use of our services
Your violation of these Terms
Your violation of any law or third-party rights
Your content or messages sent via our platform
12. TERMINATION
We may suspend or terminate your access to our services:
If you violate these Terms
If required by law or regulatory authority
If Meta suspends your WhatsApp account
For any other reason at our discretion
Upon termination:
Your right to use our services stops immediately
We may delete your data (unless required to retain by law)
Outstanding payments remain due
13. GOVERNING LAW & DISPUTE RESOLUTION
These Terms are governed by the laws of India.
Dispute Resolution:
Informal Resolution: First, contact us to resolve the issue.
Arbitration: If not resolved, disputes shall be referred to sole arbitration in Mohali, Punjab.
Courts: Exclusive jurisdiction of courts in Mohali, Punjab.
14. CHANGES TO TERMS
We may update these Terms from time to time. The latest version will always be posted here with an updated Effective Date. Continued use of our services constitutes acceptance of the revised Terms.
